Concussion Lawsuit

Not to minimize the seriousness of the concussion issue, but with a firm like this, I imagine the targeted universities all rank very high when it comes to size of endowment.

Mr. Edelson, 42, is a class-action lawyer. He is also, if not the most hated person in Silicon Valley, very close to it. His firm, Edelson PC, specializes in suing technology companies, claiming privacy violations. He has gone after pretty much every tech company you have heard of — Amazon, Apple, Google — as well as many that you have not. His cases read like a time capsule of the last decade, charting how computers have been steadfastly logging data about our searches, our friends, our bodie
 
This batch includes Texas A&M, UCLA, Maryland, Richmond, Idaho, South Carolina, Mississippi, Syracuse, Pittsburgh, Georgia Tech, Notre Dame, Alabama, Iowa, Memphis, Ball State, Rutgers, Eastern Michigan and Florida A&M.
 
Can call BS if you want, but he was involved in the previous case that resulted in a $75 million settlement with the NCAA, and he opposed the settlement because he thought it wasn't enough.

Dangerous territory for those being targeted.

At 33%-40% take,surprised that more aren't teeing up many more class action suits.
UR's legal budgets are going to be recalibrated dramatically upward due to this issue and Title IX issues.So are indemnification insurance premiums.

SF, I agree. I was just saying BS about a bunch of stupid lawsuits are can damage alot of people. Everyone seems to be looking to get that easy buck
 
Do we benefit from cover of the other 17 schools at all? Some biggies in there. Unfortunately, most of them have much deeper athletic pockets.
 
we have had several young men, in recent years, probably like most universities, with concussion probs. not sure how one can focus in and prove that the player did not have the probs start at a lower level, thus only partial responsibility, if any. will be interesting and most likely just the start of this type of thing.
 
I fear this is only the beginning. Football will be under constant assault from personal injury attorneys going forward. The sport makes huge profits (NFL and P5) so an irresistible target.

"Football" did not take the concussion problem seriously enough as the data began becoming evident. There will be a price to be paid. Insurance costs will force colleges with marginal fan support to drop the sport in the foreseeable future.

Out of those other 17 schools, only 3 did not have smaller endowments than UR, interestingly enough. A&M, Notre Dame, and Pitt had larger endowments...
 
It's not just football, but hockey, lacrosse, wrestling...they all have high concussion rates. There are lawsuits in all of these sports, too. Heck, even soccer, the sport that endears millenials, has a hidden concussion problem (too many hits to the head by either the ball or someone else's head going for a ball).
 
I thought that liability insurance covered things like this.
Do we not have liability protection to cover injuries of athletes? I read the lawsuit and noted the various grounds upon which the plaintiff(s) rely, but doesn't insurance have to come in to defend and cover everything except, perhaps, the fraud allegation?
And what about the NCAA? If this does become a class action and once the word spreads through the news and as a result many more athletes are added to the class, and many more NCAA schools are added as defendants, as is often the case according to what I have read, doesn't the NCAA have the responsibility to stand in for the member schools, especially since they make the rules under which the schools supervise and administrate the programs?
How is this different from what the NFL had to do in setting up a recovery fund for its teams?
What say the lawyers on this board?
 
heck, i got one while body surfing in nags head. maybe sue nc or the atlantic ocean? you either sit at home and do nothing, let your kids do nothing or you roll the dice, small % have probs BUT if it is your kid, husband, wife, tough deal to handle.
 
Do you represent the UR plaintiff as a consultant?If so,how much are the plaintiffs attorney paying you?Daily rate or flat fee based on the monetary outcome?Do you have a conflict of interest ?Do you have to recuse yourself?

Are you assisting the plaintiff's attorney to tee up other class action suits against other universities and the NCAA?Do you provide ongoing support,random support as needed
or part time/full time support?Will you assist the attorney in the discovery phase and interrogortory phase and evidentiary phase?
